Terms of Service

Last updated 2026-10-28. Operated by Elite AI Holdings LLC.

By using Cohostbnb you agree to these terms.

1. The service

Cohostbnb provides software that hosts, co-hosts, property-management companies and rental businesses use to run their own listings: AI-drafted guest replies, templates for each booking channel's own automation, calendar sync, and automation through tools the customer connects under the customer's own account. The software does not itself co-host, manage or operate a property. Managed co-hosting is a separate service, subject to section 5a and a written service agreement. Cohostbnb is not a licensed real estate broker and does not lease or rent property for any term.

2. You are the host and operator

For every listing you connect, you (or the property owner you act for) are the host and operator of the rental. You hold the permits, register and remit any occupancy or tourist tax that a channel does not collect for you, follow your city's short-term-rental rules, and are responsible for the property, the guests and the content of every message sent from your account. City and tax notes shown during onboarding are general information to help you check your obligations, not legal or tax advice.

3. How messages reach your guests

Cohostbnb software never logs into, scrapes or sends messages through your Airbnb account or any other channel account. Messages reach a channel only (a) as templates you paste into that channel's own tools (for example Airbnb Scheduled Messages and Quick Replies, Booking.com message templates, Vrbo scheduled messages), (b) as drafts you copy and send yourself, or (c) through a property-management system or channel manager you connect under your own account and credentials. You are responsible for complying with the terms of every channel you host on.

4. Stays over 30 nights

The software does not auto-accept or auto-confirm stays longer than 30 nights; those requests are held for your own decision. Where a partner co-host acts on a listing through Cohostbnb, the software blocks stays over 30 nights on that listing.

5. Partner property managers

Independent partner management, where offered, is provided by independent partner businesses that use Cohostbnb software. Each partner contracts with you directly, sets its own fees, holds its own insurance and permits and is solely responsible for its services. Cohostbnb is not a party to your agreement with a partner and receives only its software fee from the partner.

5a. Managed co-hosting terms

Status. Elite AI Holdings LLC (2010 El Camino Real #2000, Santa Clara, CA 95050) is not a licensed real estate broker or property manager in any state. Managed co-hosting is offered only where it is lawful without a licence and only in the scope listed for your property's state, under a separate written agreement. We may decline or end services where licensing, brokerage or local short-term-rental requirements cannot be met, and we will not perform services that require a license we do not hold.

Three tiers by property state. Co-Host Pro (a percentage fee, with listing, pricing and reservation scope) is offered only in states and for properties where the law exempts that work from a broker licence; in Florida only for a unit holding a current Department of Business and Professional Regulation (DBPR) chapter 509 vacation-rental licence, whose number you supply at onboarding and we re-check at renewal. Co-Host Assist (a flat monthly fee per listing, ministerial tasks only) is offered elsewhere: you publish the listing, set prices and approve every booking and special offer, and you remain payee. In states that license this work we sell software only.

Stay cap. Services cover transient stays of 30 nights or fewer (31 in Arizona, fewer than 90 in Georgia where its statutory conditions are met). You keep your maximum stay at or below the cap; services stop automatically for any longer stay.

Owner as operator. You are the host of record, payee, and holder of every permit and registration (including a San Francisco registration number or Florida DBPR licence number where they apply). You file and remit transient-occupancy, hotel-occupancy and sales taxes and are responsible for HOA, insurance and fair-housing compliance.

No guest funds. We never collect, hold or disburse guest payments, deposits or owner funds. Airbnb pays you directly. Our fee is paid by Airbnb's co-host payout (Pro tier only) or invoiced monthly. You pay cleaners and vendors directly, or we re-bill a cost we front, at cost, on the invoice.

Authority and fees. In Assist states we act only on your written in-app approval for any price, listing or booking decision. We never create or post ads in our name, negotiate price or terms, accept or decline reservations, or touch money. Fees are tier-specific (a percentage only where Pro is available); changes need 30 days' notice and your approval. Either party may end the service on 30 days' notice, or immediately if the law changes or a licence becomes required.

Airbnb compliance and co-host warranty. Both parties follow the Airbnb Terms of Service, the Airbnb Co-Host Additional Terms, the Nondiscrimination Policy and local short-term-rental law. Airbnb does not verify co-host licences: under its terms the host is solely responsible for verifying that its co-host holds all required licences, and the co-host represents and warrants that it holds all permits, licences and qualifications required. Airbnb is not a real estate broker. We give that warranty only for the scope offered in your state.

You remain responsible for your property permits, registrations, occupancy and sales taxes, local rental restrictions and HOA rules. We remain responsible for obligations the law places on us; these terms do not transfer them to you. We give no tax, legal or licensing advice. Fair-housing and public-accommodation laws apply to every listing and guest communication; we do not screen on protected traits. You keep short-term-rental insurance; we carry general liability, E&O and cyber insurance.

6. Your credentials and data

Credentials you connect (for example a PMS API key or your own Stripe or Twilio account) stay yours. We store them encrypted per account, use them only for the features you turn on, never display them back, and delete them when you disconnect. Direct-booking payments go to your own payment account; Cohostbnb never holds guest or owner funds. We notify you of a security breach affecting your data as required by law (including Cal. Civ. Code §1798.82).

7. AI output

AI drafts can be wrong. You review drafts on plans where nothing is sent without approval, and you set the rules on plans that can send automatically. Refund, dispute, cancellation, safety and legal messages are always held for a person.

8. Liability

To the extent the law allows, our total liability for any claim is limited to the fees you paid us in the 12 months before the claim, and we are not liable for indirect or consequential damages. Nothing in these terms limits liability that cannot be limited by law (including under Cal. Civ. Code §1668).

Your account

Keep your sign-in email secure; magic links grant access to your account. You are responsible for the content of messages sent through the service.

Acceptable use

  • No unlawful, deceptive, or abusive use;

Service

The service is provided "as is". We may modify or discontinue features. These terms are governed by the laws of the operator's jurisdiction.
