What Berkeley requires

Berkeley Municipal Code 23.314 limits short-term rentals to the host's primary residence. You register with the city as a Certified Short-Term Rental Host and obtain a zoning certificate for the address. The application fee is $451.25 plus a processing fee, and you must carry $1,000,000 of liability insurance.

Un-hosted stays, where the whole home is rented while you are away, are capped at 90 days a year. Hosted stays, with you living there, are not limited the same way.

Tax is monthly here

Berkeley charges a 12% Transient Occupancy Tax plus a 2% short-term rental enforcement fee, and both are reported monthly rather than quarterly. Our statement arrives by the 5th with the taxable rent for the month already split out, so your filing takes minutes; the filing itself stays in your name.

Running a Berkeley home with us

If you rent the home while away on sabbatical, for the summer or for work travel, we plan the un-hosted calendar around those dates, hold the 90-day count on the calendar, and stop selling un-hosted nights before the cap. Stays are capped at 30 nights.

We check your city registration number is current before the first booking and before each renewal date, and we keep the $1M liability certificate on file so a platform or the city can be answered the same day.

Have ready: your Certified Short-Term Rental Host number and zoning certificate if you hold them, a copy of the $1,000,000 liability policy, the dates you will be away, and the last few monthly TOT filings if you have hosted before.
